Terms of Service
Last updated: October 10, 2026
These terms apply when you use zenwebmaster.com and when you buy services from me. They are meant to be read. If you would rather talk through any point before you agree, write to me.
1. Who these terms are with
The services are provided by Zen Webmaster, the business name of Maksym Ohorodnikov, a sole proprietor registered in France (SIREN 934 557 190). In these terms, “I” and “me” mean Zen Webmaster, and “you” means the person or business using the site or ordering a service. Contact: support@zenwebmaster.com.
For a paid project I may also send a written quote, order form or invoice. If it says something different from these terms about that project, the quote or order form wins for that point. Everything else in these terms still applies.
2. The website and the free audit
The information on this site is general and is not legal, tax or financial advice. I am not a lawyer or an accountant.
The free site audit is based on what is visible from outside your site and on the details you send. It is offered without obligation. It shows what I can see on the day, it is not a complete security review, and I cannot promise that it finds every problem.
3. Services
I offer website maintenance plans, website rental, one-off technical work, content help and consultations, as described on this site. The scope of each job is what the service page, quote or invoice says. If you ask for something outside that scope, I will tell you and quote it separately. I will not start paid work until you have agreed to the scope and the price.
4. Prices and payment
- All prices are in US dollars. Prices marked “from” are starting prices. I confirm the final price before work starts.
- If any tax applies, it is shown on the invoice.
- Setup fees and one-off jobs are paid as stated in the quote or invoice. Rental setup fees are paid before work begins.
- Monthly fees are billed monthly in advance unless the order says otherwise.
- If an invoice is overdue, I may pause the service after telling you. I will not delete your site because of a late payment without giving you notice and a chance to collect your files.
- If you disagree with an invoice, tell me promptly so we can fix it.
- I may change the monthly price of a maintenance plan with 30 days’ written notice. Rental prices are protected as described in section 6.
5. Maintenance plans
A maintenance plan (Zen Base, Zen Business or Zen E-commerce) is billed monthly. After the first month you can end it at any time by writing to me before the next billing date. Fees already paid for the current month are not refunded. What is included is described on the pricing and maintenance pages. A plan covers the platforms and the work listed there; other work is quoted separately.
6. Website rental
- Term. A rental has a minimum term of 12 months from the start date. After that it continues month to month until you or I end it with written notice, unless you buy the site.
- What you get. A working website, hosting, upkeep and support within the plan you chose.
- Who owns what. During the rental, the website, its design and its code remain mine. Your own content (texts, photos, logos, product information) always remains yours.
- Price protection. The monthly price of your plan is fixed for 24 months for the same scope of work. If my list prices rise, the increase applies only to new clients.
- Buyout. After the first 12 months you can buy the site at the price stated for your format: $490 for a one-page site, $990 for a services site, and from $1,990 for an e-commerce site. To buy earlier, you pay the remaining monthly fees of the 12-month minimum together with the buyout price.
- After a buyout. I hand over the site files, the database, your content and administrator access. Hosting, support, updates and any paid licenses are then separate and are charged separately unless you stay on a maintenance plan.
- Ending without a buyout. If you end the rental after the minimum term and do not buy the site, the site and its hosting stop at the end of the paid period. I will give you a copy of your own content on request.
7. Starter consultation
A starter consultation is priced from $49 per hour. If you order work from me within seven days afterwards, the consultation fee is credited against that work. If it becomes clear within the first ten minutes that you do not need the session, I will say so and refund the fee.
8. What I need from you
- Accurate information and prompt answers.
- The access I need to do the work, through accounts you create for me, which you can remove at any time.
- That you have the right to use the content, images and trademarks you give me, and that they do not break anyone else’s rights or the law.
- That you look after your own passwords and tell me quickly if you think an account has been compromised.
You stay responsible for your business, its products and services, and for following the laws that apply to them, such as privacy, advertising, consumer and tax rules. I do not give legal advice on these.
9. Backups and changes to live sites
Before significant changes to a live site I take a backup, so we can go back if something unexpected happens. Websites depend on hosting, plugins, themes and other software that I do not control, and any change carries some risk. I take reasonable care, but I cannot guarantee that a change will never cause a problem.
10. No guarantees about results
I do not promise particular search rankings, traffic, leads, sales or uptime. Security work reduces risk and cannot remove it. Unless your written plan or quote states a response time, I do not promise one: I answer in writing and prioritize urgent problems such as a site that is down.
11. Intellectual property
- You own your content. You give me permission to use it only to do the work you ask for.
- I keep the rights to my own tools, templates, code, methods and know-how. Where I create something specially for you and you have paid for it in full, you receive the right to use it for your business. During a rental, this right lasts for the rental, and after a buyout it is permanent.
- Third-party themes, plugins and other components remain under their own licenses.
- Unless you tell me in writing that you prefer otherwise, I may mention the project, your business name and a screenshot of the finished work in my portfolio.
12. Confidentiality
I treat the access details and the non-public business information you give me as confidential and use them only for your project. This does not apply to information that is already public, that you make public, or that I must disclose by law.
13. Third-party services
Some services rely on companies I do not control, such as hosting providers, domain registrars, payment processors and software vendors. Their own terms apply to those services, and I am not responsible for their outages or changes beyond reasonable care in choosing and configuring them.
14. Using this website
You may use this site for lawful purposes. Please do not try to break into it, overload it, copy it in bulk or use it to send spam. The site and its content are provided “as is”. Texts, images and design on this site belong to me or are used with permission, and you may not copy them for commercial use without asking.
15. Privacy
How I handle personal information is described in the Privacy Policy.
16. Warranty disclaimer
To the fullest extent the law allows, the site and my services are provided without warranties of any kind, express or implied, including fitness for a particular purpose, except those I state in a written quote or order. Some places do not allow certain disclaimers, and then only the ones allowed there apply.
17. Limit of liability
To the fullest extent the law allows, I am not liable for indirect or consequential losses, such as lost profit, lost business, lost data or loss of goodwill, even if I was told they were possible. My total liability for any claim connected with a service is limited to the amount you paid me for that service in the 12 months before the event that caused the claim. Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, for example for fraud or intentional wrongdoing.
18. Claims about your content
If a third party makes a claim because of content, trademarks or materials you supplied, you are responsible for that claim, and you agree to cover my reasonable costs of dealing with it.
19. Ending an agreement
Either of us may end an agreement if the other seriously breaks these terms and does not fix the problem within 14 days of written notice. Fees already due remain payable. When an agreement ends, you will remove my access to your accounts and I will remove any copy of your access details I hold. Sections that by their nature should continue, such as intellectual property, confidentiality, liability and governing law, continue after the end.
20. Governing law and disputes
These terms are governed by the laws of France, without regard to its conflict-of-law rules. If a problem comes up, please write to me first so we can try to solve it directly. This does not take away any mandatory consumer rights you may have where you live.
21. Changes to these terms
I may update these terms. The date above shows the current version. A change does not affect an order already agreed, unless you agree to it or the law requires it.
